Access to Funds Presentation 26 March 2008 What is an application to access funds? This is a procedure which allows an individual to obtain authority to access the funds held in, for example, a bank or building society account, in the sole name of an adult who has lost capacity. The funds requested in the application are to be used to pay for the adult's day to day living expenses, such as care home charges, clothing, holidays etc. If there are outstanding debts owed by the adult e.g. care charges to a residential/nursing home, a lump sum can be requested. Changes to Procedures On 1 April 2008, additional sections of the Adult Support and Protection ( Scotland) Act 2007, will come into force and, in doing so, further amend areas of the Adults with Incapacity ( Scotland) Act 2000. Whilst there are some minor changes relating to powers of attorney and guardianship, there will be a significant amendment to Part 3 of the 2000 Act, currently referred to as Accounts and Funds. For the first time, organisations, as well as individuals, will be able to apply to access an adult with incapacity’s funds under Part 3 of the 2000 Act in order to manage that person's day to day living expenses. Presentation on the Changes: Staff from the Office of the Public Guardian ( Scotland) will give an awareness raising presentation on the above changes at CIOBS's offices on 26 March 2008. Although a number of significant changes are being introduced, the presentation will deal principally with Part 3 - Access to Funds. Who Should Attend? Operational and legal staff employed by financial institutions who can act as point of contact and give appropriate advice and direction to their front line colleagues. This event is open to both members and non-members of CIOBS. Objective: To provide a platform to develop a partnership between the Access to Funds team at the Office of the Public Guardian and various fundholders to assist customers acting as withdrawers to set up procedures using the Access to Funds scheme.
